Counter the Attacks on Corporate Counsel Privilege

Presented by Todd Presnell (Partner, Bradley)

A highly requested and invaluable session, Todd will provide an updated version of his entertaining and engaging presentation. Attorney-client privilege seems simple in the abstract—it protects from disclosure a client’s conversations with her lawyer. But the privilege is anything but simple when applied to corporate entities. Varying jurisdictional standards, subsidiaries and affiliates, Upjohn warnings, consultants, and waiver are just a few of the privilege issues that arise when employees communicate with corporate attorneys. And courts apply a higher privilege standard to in-house lawyers’ communications with corporate representatives. This presentation discusses the privilege challenges and pitfalls facing outside and in-house lawyers on a daily basis.

As panelists are finalized for Symposium 12.0, they will be added to the agenda. All panelists are from

in-house legal departments.
